GENERAL TERMS

This document containing the terms and conditions of use of the www.heliofold.com site (hereinafter referred to as "Terms and Conditions") establishes the conditions under which any person can visit or access the www.heliofold.com site, or can use in any way the services offered through the Site.

Non-acceptance of these Terms and Conditions or any of their provisions, as they are formulated in this act, entails the User's obligation to immediately stop accessing the Site; accessing or continuing to visit the Site, any of its pages and / or use of the Service, as well as any of their components, constitutes full and unconditional acceptance of the Terms and Conditions and any of their provisions. By registering, the User fully and unconditionally accepts the provisions of these Terms and Conditions and agrees to use the Service in strict accordance with them.

 

RIGHTS OVER SITE CONTENT

The content and graphic elements of the Website, including but not limited to, the entire content in text format and any other material, transmitted in any form by and to Users (through direct viewing on the Website, through newsletters or through any other materials directly or indirectly related to the Site) belong to the Site Administrator and its partners and represent the content of the Site. Users understand and accept that in case of violation in any way and to any extent of any of the provisions of the Terms and Conditions, the Site Administrator will be able to choose in a discretionary manner for the total or partial suspension of the User's access to any Service of the Site, or for the non-publication of any content sent by the User for posting to the Site, or for the definitive prohibition of access to one or more of the facilities offered by the Site, or for the termination of the User's account on the Site, without any prior warnings or notifications and without any other formalities in this regard may be necessary.

The user of www.heliofold.com does not have the right to use (in its existing or modified form) the content of the Site for commercial purposes.

The user of www.heliofold.com does not have the right to remove the copyright and/or trademark notice from the copies of the content. Copies will be made only according to the terms of use.

The user of www.heliofold.com does not have the right to create databases or manuals by downloading the content of the Site page by page.

 

INFORMATION NOTE REGARDING THE PROTECTION OF PERSONAL DATA

According to the requirements of Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free circulation of these data, amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, the Site Administrator will manage the personal data provided by Users in safe conditions and only for the specified purposes. We inform you that the personal data that Users provide to the Site Administrator are processed for the purpose of offering the Service in optimal conditions. The users understand and accept that the personal data they provide are processed for the purpose of offering Internet services, advertising, marketing and advertising services, and statistical services in optimal conditions by the Site Administrator. The recorded information is intended for use by the operator and is communicated only to the following recipients: the persons concerned, other natural or legal persons who process it on behalf of the operator, other natural or legal persons, partners, associates from the same group as the operator. According to Law no. 677/2001, each User benefits from the right of access, intervention on the data, the right not to be subject to an individual decision and the right to go to court. At the same time, each User has the right to object to the processing of personal data concerning them and to request the deletion of the data. Users understand and accept that the deletion of their personal data will be followed by the deletion of their profile from the system and the impossibility of accessing the Service offered by the Site Administrator.

 

USER REGISTRATION

To create an account on the www.heliofold.com website, the User is obliged to use a valid e-mail address. www.heliofold.com can refuse the registration request in situations where it finds that it has used information inconsistent with reality or uses the services in a way inconsistent with normal usage.

 

PRICE

The final price paid by the Customer is the price of the product available on the website. All prices related to products and services sold through the website www.heliofold.com are expressed in Lei and include VAT.

 

REFUND PAYMENT

The total price of the parcel will be paid to the fast courier agent, at the time of receiving the products/parcel.

 

ONLINE PAYMENT

Payment for the products ordered via www.heliofold.com will be made at the time of placing the order if payment by card is chosen or when the company receives the money deposited by payment order.

After making the payment, the user will receive a confirmation email in the case of payment by card or payment details in the case of choosing the purchase by payment order.

Through www.heliofold.com, you can pay online with your personal card or by payment order, in complete safety. Cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD logos, if they have a CVV2/CVC2 code.

For the correct completion of the transaction, the data necessary to authorize the transaction must be entered in the online payment platform.

Card data processing is done exclusively through the online payment platform. SC INNOVA-TEC BUSINESS SERVICES SRL does not request or store any details related to your card and will never request your card's PIN code.

SC INNOVA-TEC BUSINESS SERVICES SRL has taken all the necessary measures to ensure the security of your data, but the transmission of data and information is the sole responsibility of the user.

The data entered to generate the orders, with the exception of those related to the bank card (card number, expiration date, etc.) will be used only in accordance with SC INNOVA-TEC BUSINESS SERVICES SRL procedures, in order to prevent any unauthorized access.

 

SERVICE DELIVERY AND CANCELLATION

Immediately after the payment is confirmed, the customer will receive by email all the details related to the registered order.

SC INNOVA-TEC BUSINESS SERVICES SRL reserves the right to validate orders before honoring them by contacting customers by phone.

The products will be delivered anywhere in Romania. Only one delivery address will be accepted for each order.

A delivery rate will be applied for orders consisting of the value of the transport fee charged by the courier.

The delivery time will be sent by phone when the order is placed; upon delivery, the signature of receipt and verification of the contents of the package in the presence of the courier is required. Any subsequent complaint regarding the lack of some elements from the received package or damage to the product will not be accepted by SC INNOVA-TEC BUSINESS SERVICES SRL

SC INNOVA-TEC BUSINESS SERVICES SRL reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons independent of SC INNOVA-TEC BUSINESS SERVICES SRL which include: government actions, force majeure impediments, wars, acts of terrorism, protests, riots, civil disturbances, fires, explosions, floods, epidemics, strikes, delays of the transport company.

If the customer is not found at the mentioned address, our courier will return at most two more times, after which the order will be returned, the customer having to bear the costs of a new shipment, regardless of the value of the products ordered.

If the customer no longer wishes to purchase the products and refuses to receive the package from the courier, or does not pick up the ordered product in time, he will have to bear the round-trip shipping costs.

We do NOT charge tax per kg. surcharge or refund fee.

All orders placed have a delivery time of 2-5 working days, from the moment of receipt and confirmation.

The order will be taken within a maximum of 24 working hours from the order.

The transport is done by fast courier services and the transport charges and freebies are valid only in the coverage area of ​​the courier companies.

Any customer can request a refund within 14 days. (According to the product return policy). The request is sent by email: office@heliofold.com, and the money will be sent to the account where the payment was made within 30 working days.

Canceling the transaction is possible and is done through a request sent by email (www.heliofold.com) to us. After canceling a card transaction, the issuing bank will unlock the blocked amount in the client's account within 1-30 days, depending on its policy. For orders paid by card, the amount will be returned to the same card used for the transaction, within a maximum of 30 days from the acceptance of the return. If the payment was made through OP, then the client will specify by email the bank account where he wants us to return the amount.

 

PRODUCT RETURN POLICY

If within 14 calendar days, for any reason, you want to cancel the purchase of your product, it is enough to send it and you will receive the money back in your account. The product, accompanied by the purchase invoice and the warranty certificate, must be returned to the address: Strada Târlungului, Săcele, 505600, Industrial Park ELECTROPRECIZIA, Brașov county, Romania, 0720780001, office@heliofold.com.

The product can only be returned in perfect condition, including the packaging and related accessories must not show signs of wear and only if a notice is sent in writing to the e-mail address office@heliofold.com that the return of the product is desired and the form is completed of return.

Denunciation of the contract is done only in writing.

The return of the products received in perfect working condition is done at the customer's expense and includes both the amount of the transport related to the shipment made at the time of purchase, as well as the transport related to the return of the product. SC INNOVA-TEC BUSINESS SERVICES SRL will refund the value of the products returned in perfect conditions - in no more than 30 calendar days from the date of receipt of the product and the written termination of the contract (cancellation of the invoice).

The refunded amount does not include the transport costs related to dispatch and return, which are borne by the customer. The amount will be reimbursed to the account of the natural or legal person who placed the order and paid the price of the product.

(D.O.A. – dead on arrival):

If the purchased products are non-functional or have manufacturing defects, they will be replaced on the spot with a functional product, provided that SC INNOVA-TEC BUSINESS SERVICES SRL is notified in writing, within 48 hours of receiving the defective product. If the product is no longer available, at the customer's choice, either it will be replaced with a similar product, or its value will be returned to the account of the natural or legal person who paid the initial value of the product. The transport costs will be fully borne by SC INNOVA - TEC BUSINESS SERVICES SRL in this case.

If the notification is made after the 48 hours mentioned above, the products are covered by the guarantee.

The return of products is subject to Ordinance No. 130 of August 31, 2000 supplemented by Law No. 51 of January 21, 2003 for the approval of Government Ordinance No. 130/2000 regarding the legal regime of distance contracts, with subsequent amendments and additions:

"The consumer has the right to notify the merchant in writing that he is canceling the order, without penalties and without citing a reason, within 14 days from receiving the product or, in the case of services, from concluding the contract."

At the Trade Register: J40/14445/2023, through legal representative Administrator Serghei Causnean, we assure, guarantee and declare on our own responsibility, according to the provisions of art. 2 of H.G. 457/2003 on ensuring the safety of users of low-voltage electrical equipment and H.G. 487/2016 on establishing the conditions for introduction on the market and operation of electrical and electronic devices from the point of view of electromagnetic compatibility, according to 448/2005 and according to H.G. 992/2005 regarding the limitation of the use of certain hazardous substances in electrical and electronic equipment, that the product/service referred to in this statement does not endanger life, health, work safety, does not produce a negative impact on the environment, does not endanger the safety of people , domestic animals and movable and immovable goods and is in accordance with the specifications and the following European electromagnetic compatibility standards: EN55022;1998+A1:2000, EN 55024:1998+A1:2001, EN 61000-3-2:2000, EN 61000 -3-3;1995+A1:2001

This declaration of conformity constitutes the legal attestation of the fulfillment of the quality conditions by the delivered product and the fact that it corresponds to the purpose for which it was executed.

WARRANTY/CONFORMITY OF PRODUCTS

This document was drawn up in compliance with the provisions of Law no. 449 of 12/11/2003 on the sale of products and the guarantees associated with them and of O.G. no. 21/08/1992 amended, added and supplemented regarding consumer protection, HG no. 394/1995 with subsequent amendments and additions.

SC INNOVA-TEC BUSINESS SERVICES SRL guarantees that the products in this warranty document accompanying the tax invoice: are new and do not endanger the life, health and safety of people and animals, correspond to the household purpose described correctly, completely and precisely in the instructions for use and in the related advertising (the technical instructions and brochures displayed on our website: www.heliofold.com, the labels and markings on the individual packaging), as well as the purposes for which products of the same type are normally used; they have no functional defects; they have the normal quality and performance parameters, which the consumer can reasonably expect, given the nature of the product and the public statements made through advertising or by inscription on accompanying labels, they have written instructions on our website: www.heliofold.com, compliance with which allows a correct installation and payment of the products and they have telephone technical consultancy offered when needed, in order to install.

INFO WEEE and battery waste: According to HG 448/2005 and HG 1132/2008 regarding waste electrical and electronic equipment (WEEE) and battery waste, consumers have the obligation not to dispose of WEE and batteries as unsorted municipal waste and to selectively collect these WEEE and battery waste. The symbol that indicates that electrical and electronic equipment and batteries are the subject of a separate collection is a wheelie bin marked with two X-shaped lines, as in the attached image:

The products bought through the online store www.heliofold.com, operated by SC INNOVA-TEC BUSINESS SERVICES SRL, RO 40519890, J40/14445/2023, sales@heliofold.com, 0040720780001, have a guarantee of at least 12 months and up to maximum 12 years, from the moment of invoicing.

SC INNOVA-TEC BUSINESS SERVICES SRL respects the rights conferred by law on the consumer. Any consumer benefits from the same rights and guarantees associated with the products sold.

In case of lack of conformity, the Consumer has the right, and the Seller undertakes to bring the products to conformity, without payment, by repair or replacement, depending on his option, or to benefit from a corresponding price reduction, or from the termination of the contract regarding those products. The term without payment refers to the costs necessary to bring the products into compliance, and does not include postal, transport, handling, used materials and packaging costs.

In case of lack of conformity, the Consumer has the right to ask the Seller first of all to repair the product or has the right to request the replacement of the product, in each case without payment, except for the situation where the measure is impossible or disproportionate.

A remedial measure will be considered disproportionate if it imposes costs on the Seller that are unreasonable compared to the other remedial measure, taking into account:

the value that the products would have had if there had been no lack of conformity; the importance of non-compliance; if the other remedial measure could be carried out without a significant inconvenience for the consumer.

A remedial measure will be considered impossible if the Seller cannot provide identical products for replacement or spare parts for repair, including as a result of the lack of related equipment or technology.

Any repair or replacement of the products will be established following a finding made by the Seller and sent in writing to the Consumer. This will be established within a maximum period of 14 calendar days from the moment the battery enters service, without any significant inconvenience for the consumer, taking into account the nature of the products and the purpose for which he requested the products. The time period established for repair/replacement cannot exceed 90 calendar days from the date on which the buyer informed the seller of the lack of conformity of the product. If the product is repaired, only new parts will be installed in it.

The consumer can request a reduction corresponding to the price or the termination of the contract in any of the following cases:

- if it does not benefit from the repair or replacement of the product;

- if the seller has not taken remedial measures within a maximum period of 90 calendar days;

- if the seller has not taken remedial measures, without significant inconvenience for the consumer.

The consumer is not entitled to request the termination of the contract, if the lack of conformity is minor.

The guarantee is excluded in cases where the lack of conformity results from:

- unauthorized changes or interventions to the products made by the Buyer or by third parties;

- use for a different purpose, in a different way or in a different environment than that recommended by the manufacturer;

- missing or damaged warranty seals or missing or damaged original labels;

- defects occurring as a result of electrical discharges from the atmosphere or contamination with liquids or foreign matter;

- installation not in accordance with the manufacturer's instructions, found in the product packaging at the time of sale or displayed on our website, or displayed on the manufacturer's website;

- the burning of lamps, light bulbs, light sources in general - which are consumable accessories and can be assembled or disassembled without using any tools;

- exposure of the products, after the sale, to: fires, blows, floods; earthquakes, and/or other incidents related to cases of force majeure, as defined by Romanian law;

- faulty transport and handling, the superimposition of weights on the products during transport, damages and accidental hits or occurring as a result of accidents;

- the products have mechanical damage (scratches, cracked or missing components, cracked or broken connectors, bent pins, etc.)

- products that, in the opinion of our specialists, motivated in writing, show malfunctions due to handling or improper installation or use that does not comply with the instructions for use (exfoliated cones, increased working frequencies, etc.), software/hardware modification.

(the finding by the company's specialists/service department of the fact that the claimed defect is due to the fault of the buyer);

- entrusting it to be repaired by other persons/firms not authorized by the Seller/Producer.

- the products worked in thermal conditions above the normal operating limit (radiators loaded with dust, blocked vents, carbonized, blackened pinches, the presence of melts, swollen capacitors, etc.)

- the products worked in thermal conditions below the normal operating limit;

- the ambient temperature should not fall below 10 degrees Celsius or exceed 38 degrees Celsius, maximum humidity 65% ​​without condensation.

- the products were subjected to overvoltages, transient regimes or lack of grounding, which led to the explosion or "shooting" of the chips or other components of the product;

- systems and components were stored in improper conditions (excessive heat, dust, vibrations, etc.)

- the installation of the product was done by an unauthorized person;

- failure to present the warranty certificate with all spaces filled in as well as the product purchase document when requesting repair/replacement. (invoice/receipt)

- non-compliance by the buyer with the transport, handling, installation, use and maintenance conditions specified in the instructions in the technical book available on the website (https://www.heliofold.com) and of which the buyer has become aware;

- the supply will be made from a socket without grounding.

- the equipment will not be protected from moisture, liquids, dust, smoke, vibrations, mechanical, thermal and electrical shocks.

- products with missing, modified or damaged manufacturing series, unsealing of equipment or components sealed by the manufacturer or modification of the series in the warranty certificate are considered part of unauthorized or fraudulent interventions and cannot be identified in order to grant the guarantee of conformity. Interventions for repair (requiring the introduction of the product in the service unit), performed by persons not authorized by the manufacturer/seller, will lead to the removal of the products from the warranty.

- correct use requires strict compliance with the instructions in the user and maintenance manual regarding safety, handling, storage and commissioning according to the user manual or the manufacturer's specifications, displayed on the official website or any rule indicated by the manufacturer/seller and in obvious agreement with the destination of the product. Products used incorrectly and in disagreement with the respective "Warranty Conditions" and defective for this reason are not covered by the warranty.

The consumer cannot invoke incomplete information to justify the visible and foreseeable damage to the product, being obliged to use it according to the information and specific warnings provided in the user manual, the warranty certificate, the product's sales website and offered by contacting the unit's ethnic service service.

In the case of lead-acid, gel or agm batteries, the warranty is lost in the following cases:

• Failure to comply with the rules for operating batteries, delivered together with the battery

• Missing identification label attached to the battery

• Failure to complete the electrolyte level on time

• Overcharging the battery

• Defects in the charging installation

• Physical damage to the battery

• Non-observance of complete charge-discharge cycles

• Not using the batteries and not periodically charging them, which leads to the deep discharge of the battery.

In the event of an unjustified request for warranty, repair or replacement of any of the products, by the Buyer, the Seller reserves the right to ask the buyer for the cost of the investigation of the product claimed to be defective.

The guarantee is not transferable, as we are not liable to third parties. The guarantee is given only to our customers, we are not in any case liable to third parties who purchase products sold by us through them.

Upon request to bring the products into compliance, the products will be sent/presented to the HELIOFOLD Service center, Strada Târlungului, Săcele 505600, Parc Industrial ELECTROPRECIZIA, Brașov county, 0720780001, sales@heliofold.com, together with a copy of the invoice/ receipt. Upon receipt of the products in the Service, a Service Sheet/Online Finding will be issued. The transport costs related to sending/presenting the product to the HELIOFOLD service center are the responsibility of the customer.

The Seller is responsible to the Consumer for any lack of conformity existing at the time of sale of the products. Until proven otherwise, the lack of conformity occurring within 2 months from the date of sale is presumed to have existed at the time of its delivery, with the exception of cases where the presumption is irreconcilable with the nature of the product or the lack of conformity.

Defective products, under warranty or extended warranty, are replaced or repaired, as the case may be, in accordance with the service policy of the Manufacturers, respecting the legislation in force. The non-functioning time appropriately extends the warranty period and runs from the moment of notifying the Seller or the service unit until the product is brought back to normal use and the written notification for picking up the product or the actual delivery of the product to the consumer.

 

APPLICABLE LAW

The law applicable to legal relations generated by accessing www.heliofold.com is Romanian law.

 

SUGGESTIONS AND COMPLAINTS

Complaints or any kind of notices or suggestions regarding how to access the owners' website are taken into account only on the basis of a written address from the visitors, sent in electronic format, completing the form provided on the Contact page.

A properly filed complaint includes the identification data of the person (surname and last name) as well as a description of the problem that is the object of the complaint. At the same time, the complaint must include at least two of the following contact details: address, telephone number, fax number and e-mail address.

After receiving the complaint, the Owner will immediately take the necessary measures to solve the reported problem and, within a maximum of 30 working days from the date of its receipt, to send a written answer through one of the communication methods provided by according to the provisions of May above.
